Terms and Conditions for XPayBot

 

Introduction

 

Welcome to XPayBot. XPayBot facilitates the automation of crypto trading on Decentralized Exchanges (DEXs) via Telegram Bot, providing users, herein referred to as “The User,” with wallets and enabling trading activities using cryptocurrencies. This document, subsequently referred to as “The Agreement,” constitutes a legally binding agreement between The User and XPayBot (herein referred to as “The Platform”) regarding the usage of services rendered through our designated Telegram interface and prospective web applications, collectively termed “The Service.”

 

By accessing, engaging with, or utilizing The Service in any capacity, you, The User, hereby consent to be unequivocally bound by the stipulations, clauses, and conditions outlined within this Agreement. Should you, The User, dissent with any segment, provision, or clause herein, your recourse shall be to abstain from accessing or utilizing The Service in any manner. Please note, XPayBot is not a registered company and holds no trademark rights concerning the products or services facilitated.

 

Article 1: Service Description

 

1.1 Overview of Service: XPayBot provides The User with a digital platform, herein referred to as “The Platform,” which enables the automation of crypto trading on Decentralized Exchanges (DEXs) via Telegram Bot, utilizing various cryptocurrencies. It is emphasized that XPayBot operates without being a registered company.

 

1.2 Applicability of Terms: The utilization of The Service through The Platform is subject to the predefined terms and conditions set forth herein. “The User” acknowledges that each transaction is bound by these overarching Terms and Conditions set forth by XPayBot.

 

1.3 Scope of Service: The Platform acts solely as a facilitator of trading activities between “The User” and the designated DEXs. XPayBot does not assume any liability or responsibility for the outcomes of trades executed through The Service.

 

Article 2: Eligibility

 

2.1 Age Requirement: The Service provided by XPayBot is strictly limited to individuals who are at least eighteen (18) years of age. By engaging with The Service, “The User” affirms, represents, and warrants adherence to this age stipulation, thereby confirming legal age and capacity to enter into binding agreements.

 

2.2 Representation and Warranty: In utilizing The Service, “The User” hereby declares and guarantees that all provided information is accurate, truthful, and up-to-date.

 

2.3 Compliance Obligation: “The User” accepts full responsibility for ensuring that their use of The Service complies with all local, state, national, and international laws and regulations applicable to their situation, including age and capacity requirements.

 

Article 3: User Obligations

 

3.1 Lawful Use: “The User” agrees to employ XPayBot solely for lawful purposes, in compliance with these Terms and all applicable laws, regulations, and guidelines.

 

3.2 Prohibited Activities: “The User” is expressly prohibited from utilizing The Service for any illicit or malicious activities, including but not limited to fraud, money laundering, or any other activity intended to cause harm or defraud others.

 

3.3 Compliance with Terms: “The User” shall adhere strictly to all terms, conditions, and guidelines set forth by XPayBot, ensuring that their conduct does not infringe upon the rights or safety of others or violate any applicable laws or regulations.

 

Article 4: Intellectual Property Rights

 

4.1 Ownership: It is acknowledged that XPayBot owns all intellectual property rights related to the services provided directly by XPayBot, including but not limited to copyrights and any other proprietary rights associated with XPayBot. However, it is recognized that certain aspects of the service may involve third-party intellectual property rights, for which XPayBot does not claim ownership.

 

4.2 Intellectual Property Protection: “The User” agrees not to infringe upon, misappropriate, dilute, or otherwise violate any intellectual property rights related to The Service, including but not limited to copyrights and any other proprietary rights owned or licensed by XPayBot.

 

4.3 Restriction on Use: “The User” is granted a limited, non-exclusive, non-transferable, revocable license to access and use The Service strictly in accordance with these Terms.

 

Article 5: Disclaimer of Warranties

 

5.1 “As Is” Provision: The Service provided by XPayBot is offered on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied.

 

5.2 No Guarantee of Uninterrupted Service: XPayBot does not warrant or represent that The Service will be uninterrupted, error-free, or completely secure.

 

Article 6: Limitation of Liability

 

6.1 Scope of Liability: XPayBot shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of The Service.

 

Article 7: Changes to Terms

 

7.1 Amendment Right: XPayBot reserves the right to modify, alter, or amend these Terms at any given time. Users will be notified of any such changes through an update posted on The Service or via other communication channels.

 

7.2 User’s Continued Acceptance: Continued use of The Service after any such changes shall constitute The User’s consent to such changes and agreement to be bound by the updated Terms.

Article 10: Acceptance of Terms

 

10.1 Confirmation of Consent: By engaging with and utilizing The Service, “The User” hereby represents and affirms that they have meticulously reviewed, comprehended, and consented to these Terms.

 

Article 11: Miscellaneous

 

11.1 Severability: In the event any provision of these Terms is held to be unenforceable or invalid, such provision will be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law.

 

11.2 Waiver: No waiver by XPayBot of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
